TERMS OF SERVICE AT YOUR OWN RISK The user/signer, hereby known as the Member, is solely responsible for the content of communications on the Internet. The service provided by Lane Fi is “as is” and at your own risk. Lane Fi denies any responsibility for the accuracy of information obtained through the service. The transmission of data over an Internet connection is subject to errors, delays, and interruptions. Lane Fi is not responsible or liable for any errors, delays, or interruptions. The Member understands that current regulatory and technical issues prohibit the expectation of privacy when using Internet services.
REPAIRS
Lane Fi is not responsible for any repair to the fiber optic equipment due to damage that is caused from an event on the Member's property. (Ex: branches, animals, lawn mower, etc.) Lane Fi will make repairs to the fiber optic equipment if a manufacturing or installation error occurs. Repairs will be billed at Lane Fi’s current hourly rates including materials. Lane Fi is not responsible for any home wifi or mesh equipment.
PAYMENT POLICY Lane Fi will invoice its Members monthly by email only, with the exception of the first invoice which will be prorated for the remainder of the existing month and will include equipment and set up fee, and is due at the time of installation. The invoice balance may be paid with cash, or card payable to Lane Fi. The payment is due on the second day of the month. After 30 days late, the service will be canceled. The balance due, plus a $30.00 administration fee, must be paid in full to reactivate the Member’s account. A deposit or full annual payment may be required. Refund Policy: Any requests for service refunds are handled on a case-by-case basis.
UNACCEPTABLE USE Lane Fi may, at its discretion, immediately terminate or reduce service to the Member upon any single or multiple incidents of the following conditions: A. Failure to pay service fees in a timely manner; B. Interfering with the distribution of Internet service to other Members and/or their equipment on the Lane Fi wireless network; C. Propagation of computer viruses and/or spyware ; D. Unauthorized entry into another person(s) or organization(s) computer, systems, and/or information; E. Unsolicited blanket emailing known as "spamming"; F. Any violation of local, state, federal or international law or that of any Sovereign Nation, and G. Forgetting to send your Mom a card on Mother’s day.
EXCESSIVE BANDWIDTH CONSUMERS Member activities that consume unusually large amounts of bandwidth can be multiple computers on the same connection, programs or servers which provide services to others via the Lane Fi network, streaming movies and music and some types of gaming software. When excessive consumption of bandwidth by a Member prevents all Member’s fair access to the Lane Fi wireless network, we reserve the right to take the necessary steps to correct the problem. These steps include, but are not limited to limiting bandwidth, disabling communication protocols, and discontinuing service without prior notice.
SERVICE SHARING If at any time Lane Fi discovers that the Member is sharing their service or has networked to others outside of the premises, without the express written consent of Lane Fi, service will be immediately terminated to the Member with no refunds of any kind.
SERVICE DISRUPTION Lane Fi does not guarantee uninterrupted service. Lane Fi will not and cannot be responsible for any disruption of Internet connectivity due to power outages, any natural disaster (including weather), damage to personal drop cables from the distribution line, or acts of the big man (GOD). All Internet service is provided on an "as is" and "as available" basis. Lane Fi does not guarantee any loss of service time, transmission errors, connectivity or quality of service. The Member acknowledges and agrees that the service is not intended to be, and will not be used as your primary or “life-line” telecommunications service. Lane Fi will make every reasonable effort to provide our Members with the best service possible.
INDEMNIFICATION Member agrees to indemnify and hold harmless Lane Fi, it's owner(s), partner(s) and contractor(s) against all losses, liabilities, judgments, awards and costs (including legal fees and expenses) arising out of or relating to any and all claims and/or losses accruing or resulting from the installation of service, equipment, materials or supplies in connection with the performance of this agreement, to any and all Members and/or any other person, firm, organization or corporation.
MEMBER EQUIPMENT Lane Fi is not responsible for maintaining or supporting any equipment owned by the Member, and is not liable for any damages to the Member’s modem, computer(s) or other equipment. For security reasons, Members may have limited log in availability to their modem while on the Lane Fi network.
SPAMMING Spamming is the sending of unsolicited e-mail. Lane Fi will not tolerate any type of spamming. Internet service of a spamming Member will be immediately disconnected without prior notice and will not be eligible for any refund(s) for termination of service due to spamming.
PAYMENT AUTHORIZATION The Member authorizes Lane Fi to charge Member’s credit card or debit card (“UPG Card Payment”), or initiate electronic funds transfer out of Member’s bank account (“EFT Payment”) for payment of all Service Fees, the Termination Fee or any other amounts payable under this Agreement. Additionally, you, the Member, agrees that Lane Fi will bill Member’s monthly Service fee in advance, and such Service fee will automatically be collected through either a Card Payment or EFT Payment. With respect to such charges the following authorization applies: You authorize automatic Card Payments or EFT Payments by Lane Fi.
BILLING ERRORS Subject to applicable law, Member must notify Lane Fi of any billing errors or other requests for credit within 45 days of receiving the statement on which the error or problem appeared.
MEMBER SERVICE We Guaranty customer service from 10am to 5pm - 7 Days a week. We look forward to chatting with you during these hours for billing assistance or for getting connected with our service. For assistance with your internet or would like to report an outage, please send us a text to our phone number. We try our best to be available outside of these hours for any of our Member's needs.
INSTALLATION The Member authorizes Lane Fi or its Installers(s)/Contractor(s) to install the necessary wiring and modem required for Fiber Optic Internet/Fiber to the Home service on the premises specified by the Member at the time of installation. Fishing of walls and/or attic crawling is not included with standard installation. Any requests for custom installation work will require additional charges by our installers(s)/contractor(s). Lane Fi and its Installers(s)/Contractor(s) will not be liable for any alterations to Member’s premises that result from the installation or removal of the drop cable and modem, including any holes in walls, cable wiring or mounting brackets; although great care will be used to make the installations appealing. Member Agrees to all Underground/Trenching Spec Guidelines (found at www.lanefi.com/undergroundguide)
- Conduit must be placed in trench and stubbed at nearest power pole and house (within 6 inches)
- The trench must be a minimum of 18 inches deep
- Conduit diameter must be a minimum of 1 1⁄4 inch
- Pull string must be run through conduit
- There cannot be any hard corners (sweeping corners required)
- For every 350 feet of the conduit, a hand hole must be placed
Cable is run off of a connecter from our private Fiber Optic Distribution Line. The Drop Cable is run along existing utility pole right of way, or underground in Member’s private conduit infrastructure and terminates at our modem. The Member is responsible for the purchase and maintenance to their router. A Non-Standard Installation may occur due to the height of mounting equipment, additional equipment needed, and/or additional difficulty assessed by the technician at the time of install. Written approval to begin the work, by the Member is mandatory along with payment upon completion.
